What does child support and child support arrears are “reserved” mean?
Practice area: Child Support
Both parties signed a stipulation that the Judge signed and turned into an order.
One point states: all issues regarding child support and child support arrears are “reserved”. What exactly does that mean?
ANSWER: When a court “reserves” an issue, it means that the court still has the right to decide that issue at a later time. So even if the issues of child support and child support arrears were before the court but were not decided as a part of the stipulation and order, the court “reserves” the right to come back and revisit the issue at another time. It basically means that the issues of child support and child support arrears are still open and can be decided in the future.

/ 03/31/2012When the parents are unmarried, it is more difficult for the father to enforce his child custody rights as the presumption is that the mother is best suited to look after the child, however it is still possible to make an application to Court provided there is sufficient evidence to show that the mother is unfit and that he has been having quality time with the children to the best of his ability

/ 12/09/2011If there are dramatic changes in income of custodial or non custodial parent or if the needs of the child would need additional financing the court can be petitioned for modification. In my case I had to provide complete health care insurance and since it went up 10% to 20% every year, such served as an automatic escalatory clause. The ironic thing is that all my 11 years of insurance coverage money went to waste because ex stiffed a dozen doctors around town for a mere $5 co-pay and no doctors would accept her as client anymore. 11 years of my child support went up in smoke in a crack pipe or down the drain in booze and there was nothing I could do about it. $200,000 in support and assets(think 1980’s money so adjust to a million bucks today)was just squandered away. But the outrage is over dead beat dads. Talk about gender inequality in the law….
